The Georgia Sex Offender Registry

The Georgia Bureau of Investigation maintains the state's sex offender registry and outlines what information is required to be shared on the registry.

December 11, 2011 /Law and Legal PR News/ -- The Georgia Sex Offender Registry

Public sex-offender registries allow monitoring of people convicted of sex crimes once released from incarceration. Such registries also provide warning to the community of the whereabouts of such individuals. Importantly, when deciding whether to associate with particular individuals, employers, landlords, educational institutions and others may need to check such registries.

The Georgia Bureau of Investigation is charged with maintaining that state's registry and for participating in the National Sex Offender Public Registry. The GBI works closely with county sheriffs and the Georgia Department of Corrections to collect and exchange registration information. Information is also shared regularly with other state agencies dealing with children.

On the GBI's Georgia Sex Offender Registry website, patrons can use the sex offender search page or the sexually dangerous predator search page.

For a Georgia resident, state law defines a "sexual offender" for purposes of requiring registration as someone convicted of a crime against a minor victim or of a "dangerous sexual offense," whether in Georgia or in another state or territory, or under the jurisdiction of the federal government, the military or a tribal court.

Sex offenses that are misdemeanors or committed by juveniles are exempt from the registration requirements. In narrow circumstances, certain offenders may petition for exemption.

A nonresident of Georgia is required to register in the state if:
-He or she moves to Georgia and has a prior sexual offender conviction from Georgia or another state or territory, or under federal, military or tribal jurisdiction.
-He or she is a nonresident sexual offender who comes to Georgia for more than 14 consecutive days or more than 30 total days in a calendar year to work or for any other reason.
-He or she is a nonresident sexual offender who comes to Georgia to go to school.

A "sexually dangerous predator" is:
-Anyone named a "sexually violent predator" between July 1, 1996, and June 30, 2006 or
-Anyone the Sexual Offender Registration Review Board determines is "at risk of perpetrating any future dangerous sexual offense"

An individual required to register upon leaving prison or entering the state must comply with detailed registration requirements to provide residential and other information to authorities. When such a person moves to another county, he or she must notify that county's sheriff. Homeless sex offenders also have registration requirements based on where they sleep.

Every year within 72 hours before his or her birthday an offender must reregister in person with the county sheriff.

Being required to register as a Georgia sex offender is not in itself a criminal punishment, but anyone who violates the registration laws, does not register when required to, fails to comply with the annual registration requirement or gives untrue information commits a felony.

This article only introduces the subject of sex offender registration in Georgia. The main statute on the topic is several pages long. If you have specific questions about the registry, consult with a knowledgeable lawyer.

If you face charges in Georgia for a sex crime or crime against a minor, you should contact an experienced criminal defense attorney immediately to build your defense. The cost of a conviction is too high and may include the stigma of having your name on the state sex offender registry. Registration could prevent you from getting a certain job or a residential lease.
