Five Construction Workers Injured in New Jersey Roof Collapse
Five men were injured when a roof collapsed underneath them in a New Jersey work accident that could lead to potential workers' compensation litigation.
January 20, 2012 /Law and Legal PR News/ -- Five Construction Workers Injured in New Jersey Roof Collapse
In October 2011, five construction workers were injured during a roof collapse which caused them to fall into the building below. The accident sparked the interest of the Occupational Safety and Health Administration, which investigated the accident and determined the probable cause of the collapse to be weak roof trusses.
According to the Asbury Park Press, the five men were treated for injuries ranging from chest pains to broken legs at a nearby hospital. Most were released once their injuries were treated, but one man required an extended overnight stay to monitor his condition.
Potential Workers' Compensation Litigation
Most New Jersey employers purchase workers' compensation insurance to reimburse employees who are injured on the job. If an injury is work-related, then workers' compensation benefits cover an employee's medical expenses and lost wages. In exchange, however, an employee must relinquish his or her right to sue an employer for negligence.
Occasionally disputes arise during the workers' compensation claims process. These disputes are typically between an employer, its insurance company and one or more injured employees. The New Jersey Department of Labor and Workforce Development detail, among others, points out common points of contention:
-Compensability: Is the injury or illness actually considered work-related?
-Treatment: Was the treatment received proper given the injury or illness?
-Disability: If there is a disability, is it a temporary or permanent disability?
-Death Benefits: Are dependency benefits appropriate if a worker dies on the job? How much assistance is appropriate?
Obtaining Representation
Workers who have legitimate claims deserve to be compensated while they are unable to work -- this is the tradeoff for relinquishing their right to sue. However, sometimes the process is abused when employees petition for benefits they are not entitled to.
Employees have the option of filing a workers' compensation claim on their own, but most solicit the help of an experienced attorney. Employers facing a workers' compensation claim should speak with a qualified New Jersey defense attorney immediately to discuss their rights and legal options.
